Stella M. Nickell Case:
DECLARATION OF SANDY SCOTT

I, Sandy Scott, hereby make the following declaration. I would testify under oath to the truth of each statement included herein.

I used to be one of Stella and Bruce Nickell’s neighbors when they lived in Auburn, Washington. Our respective properties were across the road from one another. I knew both Stella and Bruce fairly well and saw them on a regular basis.

FBI agent Jack Cusack initially contacted my husband, who told him he did not know the Nickell’s well at all. I think Agent Cusack called my husband first because he is a King County Police Officer. I met Agent Cusack personally for the first time on or about December 22, 1986. He asked me if I “would be willing to do some things” for him, including searching Stella’s home for any type of algae killer for fish tanks. I told him I would. He explained he had given her a polygraph examination that she flunked miserably.” He further stated that “We have her cold, believe me.” I remember thinking at the time that I would help the FBI because if she was guilty as Agent Cusack said, I did not want her in my neighborhood.

Agent Cusack asked me to do a number of things such as maintaining a surveillance of her home on two or more occasions. I was to keep track of when Stella was coming and going, and who else was coming and leaving from her property, dates, times, etc., I found a spot on the other end of our property where I could station myself to do this without being seen.

I did as I was asked, and I immediately reported all of the things I saw and found directly to Agent Cusack.

Pursuant to a specific request of Agent Cusack, I searched Stella’s house for a product called “Algae Destroyer” on or about January 18, 1987. After conducting a thorough search I reported that I could not find any “algae destroyer” but that I found only one liquid algae killer called “algae gone.” I reported that Stella did not have any solid algae killing products. I also reported that I had spoken to Stella about the subject and that she had told me that she bought it (the “algae gone”) but never used it because she had algae eating fish and that she thought the “algae gone” would kill them. I looked in the tank and she showed me the algae eating fish.

I was specifically instructed by Agent Cusack to take good notes for inclusion into a diary I was to keep, and I followed this instruction as well. Agent Cusack had mentioned that he was very concerned about Stella finding out about my scheduled Grand Jury testimony, and that if she did find out she might stop speaking to me, thereby shutting off the flow of information I was able to get for him. Eventually Stella did stop speaking to me, I presume because of my scheduled appointment to testify before the Grand Jury.

While I was visiting and speaking with Stella Nickell I spoke with her a lot. I remember specifically discussing the death of her husband with her on numerous occasions. On one occasion very soon after he had died, I asked what Bruce had died of and she told me emphysema.

Emphysema struck me as very strange, as I didn’t think that Bruce seemed like he had emphysema at all. I told Stella that I didn’t believe that he died of emphysema and that she should look into finding out what was the real cause of death. When we talked further about this, I told her to contact their family doctor or doctors and ask what they thought about whether or not Bruce died of emphysema.

When I knew Stella Nickell, I knew her to be an avid reader. She read all the time and about all different subjects. During the time I knew we talked many times about the poisonous plants around our areas such as foxglove and nightshade. Between the two of us we managed to identify at least most of the poisonous plants prevalent in our area. I am not surprised that she had books about plants that can harm people and animals because she had kids and animals on her property and was concerned about them not eating any poisonous plants.
